IV. COMLEX-USA ELIGIBILITY





                    additional attempt beyond the six-attempt limit is at the explicit request of a state licensing
                    authority. In order for the NBOME to waive the limitation of a maximum of six attempts for any
                    COMLEX-USA examination, candidates are required to obtain a petition for waiver from a
                    state licensing authority.


                    RETAKING FAILED EXAMINATIONS
                    A candidate may take (including retakes) the COMLEX-USA Level 1, Level 2-CE, or Level 3
                    examination a maximum of four times in any 12-month period; for the COMLEX-USA Level 2-
                    PE examination, a candidate may take the examination a maximum of three times in any
                    12-month period.


                    RETAKING PREVIOUSLY PASSED LEVELS
                    A candidate who has passed an examination is not permitted to retake the examination to
                    improve his or her score.

                    CHANGE OF ELIGIBILITY STATUS
                    If the NBOME is notified that a candidate was ineligible to take a COMLEX-USA examination
                    after the examination was administered but before it is scored or before the score is released,
                    the candidate’s examination will be voided and no score will be released. The candidate’s
                    record and transcript will reflect test administration with no score, and the candidate's record
                    may be annotated as “Other.” If the NBOME determines that any irregular conduct occurred,
                    the candidate’s record and transcript may be annotated with this information. See also
                    “Irregular Conduct.”

                    The NBOME may refund up to one-half of the examination fees paid by, or for, the candidate
                    in such a case under the following condition: The candidate submits in writing, including via
                    email, a request for the refund, with a written explanation satisfactory to the NBOME, within
                    30 days of the date the candidate was notified that he or she was ineligible to take the
                    examination. Otherwise, all fees paid by or for the candidate will be forfeited.
